Who these terms apply to
These Terms of Service apply when you use this website, request a free homepage mockup, ask for a quote, approve website design or redesign work, or use hosting, SEO content update, or website care services from Better Site by Benjamin.
Separate written quotes, proposals, invoices, or care plan details may add to these terms. If there is a clear conflict, the specific written agreement for your project applies for that project.
Free homepage mockups
The free homepage mockup is a temporary live preview of a possible homepage direction. It is not a complete website, a full brand system, a finished design package, or an obligation to continue.
The free mockup is supplied as a preview link only. It does not include transfer, download, export, ownership, source files, design files, website files, editable files, client editing access, passwords, hosting account access, server access, reusable code, assets, or internal working materials unless Better Site agrees in writing as part of a paid project.
If you decide not to go ahead with paid work, the preview link may be disabled, removed, or allowed to expire after a short review period without further notice. Better Site may also refuse or stop a mockup request if the work appears unsuitable, illegal, abusive, misleading, harmful, outside the service scope, or not a good fit.
Quotes, proposals, and project scope
A quote or proposal will describe the main deliverables, price, payment schedule, expected inclusions, and any key assumptions. Work outside that scope may require a new quote or written approval.
Website design projects may include design, mobile-friendly layout, contact sections or forms, basic SEO setup, simple launch support, redesign work, and other items stated in the accepted package or quote. Services not listed in the quote are not included unless Better Site agrees to add them.
Payments, deposits, and invoices
Prices on the website are shown in New Zealand dollars. Quotes and invoices confirm the final price, due dates, any upfront payment, balance, and any applicable tax details for your project.
The current public package offers are:
- Starter One-Page Site: $199.
- Better Business Site: $499.
- Redesign / Glow-Up: $249.
The free homepage mockup is free as a temporary preview link only. If you continue with paid work, the accepted quote confirms the scope, any upfront payment, and the remaining balance due before delivery or launch. Other work, care plans, hosting-only services, existing-site support, or custom requirements may use a different quoted payment schedule. Better Site may pause work, delay launch, withhold delivery, or suspend services if invoices are overdue, after giving reasonable notice where practical.
Revisions and changes
Reasonable revisions may be included where stated in the quote or project discussion. A revision means an adjustment to work already within scope.
New pages, new features, rewritten strategy, major layout changes, late content changes, integrations, ecommerce, booking tools, custom apps, advanced forms, or work not included in the original scope may require extra time and cost.
Client responsibilities
To keep the project moving, you are responsible for:
- providing accurate business details, content, links, feedback, access, and approvals on time
- making sure any text, images, logos, reviews, testimonials, or files you provide can legally be used
- checking facts, prices, service details, spelling, contact details, legal wording, and industry-specific claims before launch
- checking whether your website content meets any industry rules, consumer law, privacy, accessibility, health, finance, advertising, or professional obligations that apply to your business
- responding to reasonable requests needed to finish, launch, host, maintain, or hand over the website
Delays in content, feedback, approvals, or access may delay delivery or require a revised timeline.
Client content and business claims
You remain responsible for the accuracy and legality of content connected with your business. Better Site may help write or tidy website copy, but you must review and approve the final wording.
You must not provide content that is false, misleading, unlawful, confidential without permission, copied without permission, defamatory, or in breach of another person's rights.
Domains, hosting, and care plans
Domain names are usually registered in the client's name or under an account the client can control, unless otherwise agreed in writing. Domain renewal, registrar fees, DNS access, and ownership details are confirmed before launch where domain work is part of the agreed scope.
Domain setup, SSL setup, email hosting, ecommerce, payment tools, booking tools, client editing access, and third-party integrations are only included if the quote or plan specifically says so.
Hosting and website care services are covered by the Hosting & Care Plan Terms. Monthly care plan inclusions depend on the selected plan and the accepted quote.
Ownership and handover
Once the agreed website design fee has been paid in full, the client owns the final approved website work and client-specific content created for that paid project, unless a quote or written agreement says otherwise.
A free mockup does not transfer ownership or give the client rights to copy, rebuild, export, download, reuse, or receive the files behind the preview. Handover only applies to paid work, and only to the extent included in the accepted quote or agreed in writing.
Better Site keeps ownership of its pre-existing tools, systems, know-how, working files, reusable methods, templates, code patterns, and internal processes. Third-party tools, fonts, images, software, platforms, plugins, stock assets, and services remain subject to their own licences and terms.
Technical handover, source-file export, editable working files, client editing access, passwords, private accounts, server configuration, provider credentials, internal notes, unused concepts, or mockup files are only included if agreed in writing.
Third-party tools and platforms
Websites may depend on third-party tools or services, such as hosting providers, form processors, email services, domain registrars, DNS providers, fonts, maps, review platforms, website platforms, or payment tools.
Better Site is not responsible for third-party outages, price changes, policy changes, account restrictions, data loss, discontinued features, or service changes outside its reasonable control.
No guaranteed business outcome
Better Site aims to create professional, useful websites with clear content and practical SEO foundations. It does not guarantee specific search rankings, traffic, sales, enquiries, bookings, revenue, conversion rates, Google placement, or business outcomes.
Business and consumer rights
Many Better Site customers are small businesses using the services for business purposes. Some consumer laws may apply differently to business-to-business work, and some rights cannot be excluded.
If you acquire services in trade for business purposes, then to the extent permitted by New Zealand law and where it is fair and reasonable, the parties agree that the Consumer Guarantees Act does not apply to those business-purpose services. Nothing in these terms is intended to remove rights or remedies that cannot legally be removed under New Zealand law.
For services where non-excludable consumer guarantees apply, Better Site may first be given a reasonable opportunity to fix a service problem where the law allows that. These terms do not create a change-of-mind refund right for custom website work that has already been started or completed.
Limitation of liability
To the maximum extent allowed by New Zealand law, Better Site is not liable for indirect loss, lost profit, lost revenue, lost data, lost opportunities, reputation loss, or business interruption.
Where Better Site is legally responsible for a loss, liability is limited to the amount paid by the client for the specific service that caused the issue, unless the law does not allow that limit.
Nothing in these terms is intended to limit rights that cannot be excluded under New Zealand law, including any applicable rights under the Consumer Guarantees Act or Fair Trading Act.
Refusal, cancellation, and termination
Better Site may refuse, pause, or end work where a request is illegal, abusive, misleading, harmful, unsafe, unpaid, outside scope, or in breach of these terms or the Acceptable Use Policy.
You may cancel a project or monthly service by contacting Better Site. Refunds, final invoices, current-month fees, and handover after cancellation are covered by the Refunds & Cancellations Policy and the Hosting & Care Plan Terms.
Governing law
These terms are intended for a New Zealand business context and are governed by the laws of New Zealand, unless a written agreement says otherwise.
